A divorce, otherwise known as a dissolution of marriage, is the legal termination of marriage.
The divorce process begins when one spouse files a Petition for Dissolution of Marriage. Within the petition, the filing spouse must establish grounds for the divorce. In Illinois, the only recognized grounds for divorce is irreconcilable differences, which is known as the “irretrievable breakdown” of a marriage. The filing spouse is required to prove to the court that there has been a breakdown in the marriage, that all efforts at reconciliation have failed, and that all future attempts at reconciliation would not be “in the best interests of the family.” If the parties in a divorce proceeding have come to an agreement, the agreement will be memorialized into a marital settlement agreement which is incorporated in a judgment for dissolution of marriage. If the parties have minor children (under the age of 18), there will be an additional document known as an allocation judgment, which delineates the parental responsibilities for the children including, but not limited to, decision-making authority and a parenting time schedule.
